John is often listed as "John K" but Judy Jennings, who has done a lot of research on this family - and almost everything published here - has found no documentation for the "K." It was possibly his mark.

78b - 1803, District Court, Monogalia County.
John Arnold and others sworn to give evidence to the Grand Jury on an indictment against George Keyser for horse stealing. Indictment: George Keyser, laborer, was indicted on charges of stealing 1 bay horse and 1 bay mare from John Arnold, late of Monogalia County, of the value of $100 each, September term 1803. Appearance bond for John Arnold and Caleb and John Bennett to ensure they would appear and give evidence against Keyser, 14 July 1803. John Arnold’s deposition: He missed his horses and went into the woods to hunt them, came upon their track in Maryland and followed them into Virginia “to a small glade or muddy place and discovered the track of a man’s shoes and (haney?) [me - hands?], both on soft ground, which the shoe track appeared to be a sharp toed shoe or spring heeled slipper. After which he pursued on the road to Morgan’s Town and came to the house of John Bennett and informed him that he had lost a horse and a mare that he suspected had been stolen and gave Bennett the marks of said horses and the next morning “was standing on the hill above Kerns’ Mill in Morgan’s Town when he saw John and Caleb Bennett and the said George Keyser who was riding on the horse and leading the mare.” Deposition of John & Caleb Bennett: The morning after Arnold was at John’s house, he was summoned by his dog barking and saw a man passing by riding and leading another creature. He ran down to Caleb’s, his borther’s house, and told him Arnold’s story and they pursued along the road to Morgantown until they overtook him and after some consideration told the man that they had reason to believe the horses were stolen and upon examining the creatures found them to have the same brand and markings as described by Arnold and took the man and horses to Morgantown and on the hill on this side of the town met Arnold who then owned the horses, after which he was taken before a Justice of the Peace and committed. September 1803 term of court - jury found him guilty, sentenced to jail for 3 years, horse ($100) and mare ($40) have been returned to owner. The prisoner to spend 1/3 of his sentence in solitary confinement.

“I also give and bequeath to my daughter Elizabeth Arnold 125 acres of land lying in Monongehely County & State aforesaid (Virginia), whereon she has lived”

“That the Ashby’s seemed to have an obsession to possess land is related to the fact that John Arnold, William Wilton Ashby’s son-in-law, occupied land granted to the pioneer covering 500 acres “by pre-emption assignee of Jacob VanMeter” is what is now Preston County.
This was to become known as the Nordeck settlement. It included the town later called Freeport (1920-30).
My evidence in this is the fact that the land was on a southwest tributary of Laurel Run, which flows into the Youghiogheny River at Crellin, and is today known as Laurel Run. The land was located between Arnolds Run and Little Laurel Run, which is a northeast tributary. The 500-acre tract was later cut up and sold to the Nordecks, John VanVorth, and Samuel P. Crane.
This is noted in the History of Preston County published in 1882. Some writing relation to this locality in Maryland states that John Arnold settled on Cherry Creek. [Same parcel land called “Cherry Creek” deeded to William Arnold in 1842 Allegany Co Deed Bk CC pg 486/87]
In this regard we have talked with Ray C Arnold, a descendant [grands/o David S Arnold s/o William Arnold s/o John Arnold], who believes the land in question was on the southwest branch of Cherry Creek near the Hurley Miller farm that joined the later site of Mason School.
He states that there are some unmarked graves there and believers they may be those of John and Elizabeth Ashby Arnold.”
John Arnold & Eliza Ashby lived in [now] Preston Co until after the death of William Wilton Ashby, Elizabeth's father, then they lived less than 5 miles south of Oakland Md. Garrett Co., the "backbone of America" - from Judy Jennings.

“On 8 November 1804, Arnold was living in Maryland”
83a - 1805, District Court, Monongalia County. John Arnold summoned to answer to those things of which he stands indicted (assault upon Joseph Kelso on 14 September 1803), 2 November 1803, 8 June and 8 November 1804. On 8 November 1804 Arnold was living in Maryland. Kelso summoned to testify against Arnold 8 June and 8 November 1804. May 1805 term of court “nolle prosequi” (further action dropped) [Same citation as above - this from V. 3]
The man that stole the horses from John also supposedly stole a saddle and harness from Joseph Kelso - and John and Joseph Kelso got into a kerfluffle - curious,no? And neither of them bothered to show up in court, so eventually the case was dropped. Hmmm.
